Sales Agreement

SALES AGREEMENT

  1. SUBJECT

This Sales Agreement Preliminary Information Form outlines the rights and obligations of the parties concerning the sale and delivery of the products listed below, sold by the SELLER to the ORDERING PARTY/BUYER, in accordance with the provisions of the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188). By accepting this preliminary information form, the BUYER agrees and acknowledges that, in the event of confirming the order subject to this agreement, they will be obliged to pay the specified order amount and any additional charges, such as shipping fees and taxes, if applicable.

  1. PRODUCT(S) SUBJECT TO THE AGREEMENT

4.1. The basic characteristics (type, quantity, brand/model, color, number) of the product(s) are available on the SELLER’s website. These characteristics can be reviewed during the campaign period, if applicable. 4.2. The prices listed and announced on the website are the sales prices. The announced prices and commitments remain valid until they are updated or modified. Periodically announced prices are valid until the specified date. 4.3. The total sales price, including taxes, of the goods or services covered by this agreement is shown in the table below:

  1. GENERAL TERMS

5.1. The BUYER acknowledges and declares that they have read and understood the preliminary information about the product’s essential characteristics, sales price, payment method, and delivery terms on the SELLER’s website and has confirmed this information electronically. By confirming the Preliminary Information electronically, the BUYER acknowledges that they have obtained the correct and complete information required before the distance sales contract is established.

5.2. Each product subject to the agreement will be delivered to the BUYER or the person/entity designated by the BUYER within the time frame specified in the preliminary information section on the website, not exceeding the legal period of 30 days, depending on the BUYER’s place of residence. If the product cannot be delivered to the BUYER within this period, the BUYER has the right to terminate the contract.

5.3. The SELLER agrees to deliver the product in accordance with the specifications indicated in the order, free of defects, with warranty documents and user manuals, if any, in compliance with legal requirements, and with due diligence and care.

5.4. The SELLER may provide a different product of equal quality and price, subject to the BUYER's explicit approval, before the fulfillment period ends.

5.5. If it becomes impossible for the SELLER to fulfill their obligations for the ordered product or service, the SELLER will notify the BUYER within three days and refund the total amount to the BUYER within 14 days.

5.6. The BUYER acknowledges that if the payment for the product is not made or is canceled by the bank, the SELLER has no obligation to deliver the product.

5.7. If the product has been delivered and the BUYER’s credit card is used fraudulently by unauthorized persons, resulting in the payment being canceled by the bank, the BUYER agrees to return the product to the SELLER within three days at the SELLER’s expense.

5.8. In cases of force majeure preventing the timely delivery of the product, the SELLER will notify the BUYER. The BUYER may then choose to cancel the order, request a replacement product, or agree to extend the delivery period. If the BUYER cancels the order, the payment will be refunded within 14 days. Refunds made via credit card will be returned to the respective bank within 14 days, and the reflection of the refund in the BUYER’s account depends on the bank’s process, which may take two to three weeks.

Invoices are sent as e-invoices to the BUYER’s email address following the dispatch of the order.

  1. RIGHT OF WITHDRAWAL

7.1. To exercise the right of withdrawal, the BUYER must notify the SELLER in writing via registered mail, fax, or email within 14 days. The product must be unused, and the provisions concerning "Products for Which the Right of Withdrawal Cannot Be Exercised" must be observed. Upon exercising the right of withdrawal:

7.1.1. The original invoice for the delivered product must be returned (if the invoice was issued to a company, a return invoice must also be provided).
7.1.2. The return form must be completed.
7.1.3. The product must be returned complete and undamaged, along with its packaging and any standard accessories.
7.1.4. The SELLER will refund the total amount and any obligations within 10 days and accept the return of the product within 20 days.
7.1.5. If the value of the product decreases due to the BUYER’s fault, or if the return becomes impossible, the BUYER is responsible for compensating the SELLER for the damages. However, the BUYER is not responsible for changes or deteriorations that occur due to proper use of the product within the withdrawal period.
7.1.6. If the right of withdrawal results in the campaign limit being exceeded, the discount amount will be canceled.

  1. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

8.1. a) Products whose prices are subject to fluctuations in the financial markets beyond the control of the SELLER.
b) Products customized according to the consumer’s requests or personal needs.
c) Perishable goods or products with a potential expiration date.
d) Products whose protective elements (packaging, seals, etc.) have been opened and which are unsuitable for return for health or hygiene reasons.
